Late night driving restriction

A late night driving restriction prohibits you from driving between the hours of 11 pm on a day and 5 am on the next day for at least one year.

A late night driving restriction will be imposed on P, P1P2 type licence holders who accrue excessive demerit points or commit a high speed offence while under 25 years of age (and the latest offence was committed after 30 June 2007) that results in either a licence suspension or a good driving behaviour period.

This restriction will begin the day after your suspension period has been successfully completed, providing you then hold a valid licence, or on the day you begin your good driving behaviour period.

A late night driving restriction will also be imposed on P, P1 or P2 type licence holders or open licence holders who are convicted of an offence, that was committed after 30 June 2007 while they were under 25, that results in a disqualification from holding or obtaining a Queensland driver licence.

This restriction will begin the day you reapply for your licence after you have successfully completed the disqualification period, or the day after your restricted licence order has been served.

Any time that your licence is suspended, cancelled or expired will not contribute to the minimum one-year period.

Exemptions

The Certificate of Exemption late night driving information sheet (Form S4479) provides general information to you if you are prohibited from driving between 11 pm on a day and 5 am on the next day and you believe that you have a need to drive a motor vehicle on a road between these hours.

To gain an exemption you need to prove that:

  • you need to drive a vehicle to or from your place of employment
  • you need to drive a vehicle in the course of your employment
  • refusal of your application will cause severe hardship.

Your traffic history will also be taken into consideration when your application is assessed.

If you drive between the hours of 11 pm on a day and 5 am on the next day while under a late night driving restriction, penalties apply. A driver who holds an exemption must produce this certificate when asked to by a police officer. Failure to do so will lead to a fine and demerit points.
