Cardholder terms and conditions
It is important that you make yourself familiar with the cardholder agreements (PIN Terms of Use and Subscriber Agreement) before using your PIN or shared secrets. These documents can be viewed below and a copy will be mailed to you with your new card.
PIN Terms of Use
The PIN Terms of Use (PDF, 117 KB) is a cardholder agreement, which sets out all the terms and conditions you will need to know to use the Personal Identification Number (PIN) function on your new card.
Subscriber Agreement
The Subscriber Agreement is an agreement between you (the cardholder) and the Department of Transport and Main Roads. It sets out the terms and conditions that apply to certain electronic features of your new card, such as the shared secrets function.
The Subscriber Agreement, a list of effective dates for previous Subscriber Agreements, notices relating to the Subscriber Agreement and other related matters are available below.
It is important to remember to:
- keep your card and any record of your PIN or shared secrets secure at all times
- not keep a record of your PIN or shared secrets with or near your card
- not tell anyone your PIN or shared secrets including family members, friends and licence issuing officers
- not allow anyone else to use your card, PIN or shared secrets
- notify the Department of Transport and Main Roads immediately if you suspect that your PIN or shared secrets have become known to someone else.
The Department of Transport and Main Roads issued cards are only designed to meet the needs of driver licence, marine licence, industry authority or adult proof of age purposes without regard to any other uses. Accordingly, cardholders, and other persons/organisations relying on the cards, need to be satisfied as to the adequacy and appropriateness of using the cards for any other purpose.
Any party relying on the card needs to:
- satisfy themselves that the card’s personal information is sufficiently authentic and accurate for their purposes
- be aware that in collecting personal information, a relying party remains subject to privacy laws that may apply to them or their activities
- recognise that it is an offence to access information on a card chip without the cardholder’s consent, and that it is necessary for any relying party to obtain the cardholder’s consent to access any information on the card chip, including:
- consent to access items of information on the card obtainable without PIN-entry by the cardholder
- consent to access items of information on the card only obtainable with PIN-entry by the cardholder (e.g. by giving or displaying to the cardholder a list of the items of information on the card chip which will be accessed with consent).
The Department of Transport and Main Roads will not be responsible for any use of the card as evidence of identity for non-departmental purposes or anything arising out of that use.
Cardholders should be aware of the possibility that third parties may undertake ‘data harvesting’ activities, which is the process of combining items of information about an individual from different sources to develop a profile. It is important for a cardholder to remember that their first and best defence against fraud or misuse of your card, or the inappropriate capture, storage and use of your information is to protect your card and the security of your PIN and Shared Secrets.
Repository
The following Subscriber Agreements apply to cards issued between the specified commencement and end dates. The department maintains a separate repository of Public Key Infrastructure (PKI) information for each relevant Subscriber Agreement (Agreement) at the URL specified.
An addendum or erratum may be issued for Subscriber Agreements applying to cards issued between the specified commencement and end dates.
