Burdekin River Bridge 60th anniversary competition

We have a winner! Thank you to everyone who entered the Burdekin River Bridge 60th anniversary competition. We received 91 entries and as you can see from the amazing photos below, the old girl doesn’t look a day over 21!

Our 3 judges had a tough time choosing the winning entry but after some deliberation the judges chose a photo submitted by Rachel Kneubuhler. The judges chose the photo as they believe it shows what the bridge is really all about; it provides a vital and reliable road and rail link from southern Queensland to northern Queensland, transporting passengers and freight across the mighty Burdekin River.

Congratulations to our winner Rachel Kneubuhler who has won the experience of a lifetime for her and a friend to climb the Burdekin River Bridge right to the top gantry (which you can see in her winning photo!).

Congratulations also goes out to our highly commended entries and three entries who get a special mention for their personal connection to the bridge.

Burdekin River Bridge 60th Anniversary Competition Terms and Conditions

By entering the Burdekin River Bridge 60th Anniversary Competition (the “Competition”), you agree to the following terms and conditions:

1. THE PROMOTER

1.1 The Promoter is the State of Queensland (represented by the Department of Transport and Main Roads (ABN 39 407 690 291) of Floor 5, Verde Tower, 445 Flinders Street, Townsville Qld 4810.

2. STANDARD TERMS

2.1. By entering the Competition you are deemed to have accepted these terms and conditions.

2.2. If there is any inconsistency between these terms and conditions and anything else that refers to this competition, these terms and conditions will prevail.

3. WHO CAN ENTER

3.1. Entry is open to all residents of Queensland except employees and immediate families of the Department of Transport and Main Roads. To avoid any doubt, all employees and their immediate families of all other departments of the Queensland Government are eligible to enter. Immediate family includes the following: parents, siblings, defacto, spouse, children and grandparents.

3.2. To enter the Competition, you must be over 18 years old and must be of sound physical ability, capable of walking short distances at height.

3.3. By entering the Competition, you are providing consent for the Promoter to use your personal information to determine your eligibility to win the Competition and contact you if you are the winner. You acknowledge and agree that, if you are selected as the winner, your name and the winning image will be posted on the Promotor’s website as well as its social media pages.

4. WHEN AND HOW TO ENTER

4.1. The Competition commences on Friday 4 August 2017 at 9:00am (AEST) and concludes on Friday 25 August 2017at 17:00pm (AEST) (the “Competition Period”).

4.2. To enter the Competition, you must take your own original photo of the Burdekin River Bridge, located on the Bruce Highway south of Ayr, Queensland (the “Image”) and, using your own registered account, post the Image to Facebook during the Competition Period as a public post and label the Image using the #BRB60years hashtag.

4.3 Multiple entries are permitted and will be considered provided that each entry complies with the requirements at clause 4.2 above. 4.3. The time of entry will, in each case, be the time that the entry is recorded as posted on the entrant’s Facebook page.

5. HOW TO WIN

5.1. Each entrant who has entered the Competition during the Competition Period in accordance with clauses 3 and 4 will qualify for judging of the Image(s) submitted. The judging of entries will take place at Verde Tower, 445 Flinders Street, Townsville Qld 4810 on Monday 28 August 2017.

5.2. One winner will be selected from all valid entries. The winning entry will be decided by a judging panel comprised of representatives of the Promoter.

5.3. The winner will be notified by direct private message to their Facebook account sometime between Monday 28 August 2017 to Wednesday 30 August 2017.

5.4. The winner will be required to provide the Promoter with his or her full name, postal address and other information the Promoter may reasonably require.

5.5. The winner and their name and the winning Image will be published on the Promotor’s website (www.tmr.qld.gov.au), the Promoter’s social media pages and, at the Promoter’s discretion, third party social media pages, publications or websites (including those of local media).

5.6. The Promoter’s decision in relation to any aspects of the Competition is final and the Promoter will not enter into any correspondence regarding the result.

5.7. The Promoter reserves the right to verify, or to require the entrant to verify, that an entry (including the relevant Image) is the entrant’s original work. If an entry cannot be verified to the Promoter’s satisfaction, the entry will be deemed invalid.

5.8. An entry must not include anything that contravenes any law, infringes the rights of any person or is potentially insulting, inflammatory, defamatory, obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or winner’s entry is of a type described in this clause.

5.9. Any entry that is made on behalf of an entrant by a third party will be invalid, unless the entrant requires the assistance of a third party to enter due to a disability.

5.10. The Promoter reserves the right to request the winner to provide proof of identity.

5.11. In the event that the winner cannot provide suitable evidence of identity, the winner will forfeit the Prize in whole and no substitute will be offered.

5.12. Entries not completed in accordance with these terms and conditions will not be considered valid and will not be included for consideration by the judges. Indecipherable or incomplete entries will be deemed invalid.

5.13. By entering this Competition you agree to provide the Promotor (including its affiliates and subcontractors) with a non-exclusive, royalty-free, perpetual, worldwide, irrevocable and sub-licensable right to use, reproduce, modify, adapt, publish and display the Image in any media without remuneration, attribution or liability.

6. PRIZE

6.1. The winning entrant will receive the opportunity for the winner and one (1) other person nominated by the winner (“winner’s companion”) to climb the Burdekin River Bridge, located on the Bruce Highway south of Ayr, Queensland, including walking the bridge structure and climbing to the top of the bridge via the gantry escorted by and under the supervision and direction of representatives of the Promoter (the “Prize”).

6.2. The Burdekin River Bridge climb that constitutes the Prize (the “Climb”) will be on a day and at a time to be agreed between the Promoter and the winner, but which is to be a date no later than 31 December 2017.

6.3. Travel to and from the Burdekin River Bridge is not included as part of the Prize. The winner and the winner’s companion must be able to travel to and from the Burdekin River Bridge at their own expense, to attend on the day and at the time agreed between the parties in accordance with clause 6.2.

6.4. If the winner is unable or unwilling to comply with clauses 6.2 or 6.3, the Promoter reserves the right to select another winner and the original winner will forfeit the Prize.

6.5. The name of the winner’s companion will be required to be notified to the Promoter, using the form to be provided to the winner by the Promoter, not less than 14 days before the date of the Climb, which form will include agreement to the relevant aspects of these terms and conditions by the winner’s companion.

6.6. By entering the Competition and accepting the Prize, the winner warrants that both the winner and winner’s companion are of sound physical ability, capable of walking short distances at height and that neither of them suffer from any medical condition that might reasonably be expected to be aggravated by the Climb or to adversely impact on their ability to safely complete the Climb. Despite this warranty, the Promoter reserves the right to cancel the Climb if not satisfied that the winner or winner’s companion are of sound physical ability to complete the Climb.

6.7. The winner and the winner’s companion must comply with all required personal protection equipment and site safety requirements, as advised by the Promoter at all times during their attendance at the Burdekin River Bridge site and the Climb. Failure to comply with any part of this clause 6.7 may result in immediate cancellation of the Climb, in which case the winner will forfeit the Prize.

6.8. The Prize cannot be transferred, exchanged or redeemed for cash. If for any reason the winner does not accept the Prize, the Prize will be forfeited by the winner and cash will not be awarded in lieu.

6.9. If, for any reason, the Prize is unavailable (including, without limitation, because of inclement weather on the agreed date for the Climb or technical or other difficulties beyond the Promoter’s reasonable control), the Promoter, in its discretion, reserves the right to negotiate an alternative day and time for the Climb with the winner or to substitute the Prize with a Prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

6.10. The winner and winner’s companion each agree to participate and co-operate as required in all activities related to the Competition, including but not limited to being interviewed and photographed (“Promotional Activities”). The winner and winner’s companion each agree to grant the Promoter a royalty free, perpetual and exclusive right to use any material arising from the Promotional Activities.

6.11. The winner and the winner’s companion cannot bring cameras on site or take photos with any equipment housing recording devices or inbuilt cameras. Photographs of the Climb will be taken by the Promoter’s personnel as part of the promotional activities, with copies being provided to the winner if requested.

6.12. The winner and winner’s companion each consent to the use of their name, likeness, image and/or voice (including photograph, film and/or recording of the same) by the Promotor, in any media, for an unlimited period without remuneration for the purpose of promoting this Competition and for any of the uses stated in these terms and conditions.

6.13. It is a condition of accepting the Prize that the winner and the winner’s companion must, prior to the Climb, sign any legal documentation as, and in the form, determined by the Promoter and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form, image release or other consent forms and any documents considered necessary by the Promoter.

7. NO LIABILITY

7.1. None of the Promoter or its officers, employees and agents will be responsible or liable for:

7.1.1. any loss or damage whatsoever which is suffered (including but not limited to direct, indirect, special or consequential loss), or for any personal injury suffered or sustained in connection with, the Competition or the Prize;

7.1.2. any incorrect or inaccurate information, either caused by the entrant or any of the equipment or programming associated with, or utilised in this Competition, or for any technical error, or combination thereof that may occur in the course of the administration of this Competition, including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite failure, theft, or destruction or unauthorised access to, or alteration of, entries;

7.1.3. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);

7.1.4. any theft, unauthorised access or third party interference;

7.1.5. any entry or Prize claim that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter;

7.1.6. any variation in Prize value to that stated in these conditions or entry;

7.1.7. any tax liability incurred by a winner or entrant; or

7.1.8. the broadcast of any program relating to the Competition or the publication of any material, including statements made by any person, except for any liability that cannot be excluded by law.

7.2. If for any reason, this Competition is interfered with in any way or is not capable of running as planned, including due to infection by computer virus, bugs, tempering unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the Competition subject to any written directions given by a regulatory authority.

8. PRIVACY

8.1. Your personal information will not be disclosed by the Promoter to any other third party, without your consent unless provided by these terms and conditions or as required or authorised to do so by law.

8.2. The Promoter collects personal information ("PI") of entrants and the winner (including to notify the winner), and may, for purposes associated with the Competition, disclose such PI to third parties, including but not limited to agents, contractors, service providers and Prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.qld.gov.au/legal/privacy/. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Information Privacy Principles or any other applicable law and how those complaints will be dealt with.

9. FACEBOOK

9.1. The Competition is in no way sponsored or endorsed by Facebook. By entering this Competition you acknowledge and agree that, in accordance with your own terms of use relating to your Facebook account, Facebook will have rights to the Images posted.
