Rise and Fall Adjustments

From 1 December 2022, the general rise and fall provisions in transport infrastructure contracts will be expanded for all contract types (including MIC) greater than 90 days. Consequently, Annexures D (Covid-19) and E (Increase in Supply Cost) will be retired for new contracts and rise and fall will be the sole relief for any material price adjustments.

For contracts without Annexure D, a deed of variation is required to amend rise and fall provisions:

 

Key aspects of the TIC-CO

  • replaces the current Road Construction Contract (RCC)
  • can be used for the construction of other forms of transport infrastructure (such as marine structures and busways)
  • for open tendering (one-stage or two-stage process), Early Tenderer Involvement or Guided Tender Alternative
  • more dispute resolution alternatives, such as 'Issues Resolution Advisor' and 'Dispute Resolution Board'.
