Moving people and goods requires state-of-the-art, functional and efficient transport infrastructure, such as railways, highways, busways and light rail.
Transport and Main Roads is committed to providing an integrated transport system that is accessible to everyone.
To do this, and ensure we have a better and safer transport network, sometimes privately-owned land needs to be acquired.
If an acquisition of part or all of your property is proposed for a transport project, our officers will contact you to explain the project, how your property is impacted and the property acquisition process.
In some circumstances, early acquisition of property for future transport projects is carried out through Contract of Sale negotiations.

For resumption, Transport and Main Roads follows the process set out in the Acquisition of Land Act 1967, which protects the rights of all those involved.
When the property resumption process is ready to be commenced, you will receive a Notice of Intention to Resume. The notice sets out details of the proposed resumption and the procedure to follow if you wish to object. The right to object to the resumption is an important right of the property owner and any other person who holds a legal interest in the property.
If the resumption proceeds, and you have a right to claim compensation, you may choose to engage professional advisors such as a lawyer and a registered property valuer to assist in preparing your compensation claim.
Transport and Main Roads will engage an independent registered property valuer and any other relevant advisor (such as an accountant for business claims) to assist the department with the assessment of compensation.
We understand that the resumption of property can be an unfamiliar and stressful process.
