Transport Talk Panel Participation Agreement

Thank you for your interest in joining the Department of Transport and Main Roads' ('TMR') online customer research panel, Transport Talk, ('the panel').

If you wish to become a member of the panel, you acknowledge and agree to be bound by the Terms and Conditions of this participation agreement ('this agreement') between the participant as a member of the panel ('you') and the Department of Transport and Main Roads ('TMR', 'we', 'us' or 'our').

The Terms and Conditions of this agreement apply to your participation in and your use of the panel online tools. By accessing the online tools and participating in customer research activities, you agree to the Terms and Conditions of this agreement. If you do not agree to the Terms and Conditions of this agreement, you should not use the online tools.

The Terms and Conditions of this agreement replace any other Terms and Conditions published for the panel on the TMR website to date. TMR may at any time vary this agreement by publishing varied terms and conditions of the agreement on the TMR website. You accept that by doing this, TMR has provided you with sufficient notice of the variation.

TMR and its service providers

TMR uses online tools provided by third party companies to manage and maintain the panel on its behalf.

As at the date of this agreement, this is Qualtrics, LLC/QAL Technologies Pty Ltd ABN 25 600 791 026 (the 'service provider').

The service provider hosts your personal information on behalf of TMR. TMR has an appropriate agreement with the service provider to protect your information.

In the event TMR appoints additional service providers for the panel a notice will be posted on TMR's website.

Joining the panel

Membership is open to those who make use of TMR's products and services, who are 18 years of age or over, and who have been invited to participate and have accepted the Terms and Conditions of this agreement. However, if you are aged under 18 but over 16, you can participate as a member if your parent or guardian agrees to be bound by this agreement and to be responsible for your meeting the obligations of a member of the panel.

Employees of TMR are not eligible to join the panel. 

If you apply to join the panel, you will be asked to complete a joining survey. You must provide us with accurate, complete and up-to-date information, as requested. It is your responsibility to inform us of any changes to this information. You must not register as a member multiple times. You must not impersonate or create a membership for any person other than yourself.

We may at any time request a form of identification to verify your identity.

As part of your application to join the panel, you will be asked to agree to the Terms and Conditions of this agreement by selecting the 'I agree' response in the joining survey. If you do not agree to the Terms and Conditions of this agreement, you will not be accepted as a member of the panel.

Once you submit your answers to the joining survey to TMR's satisfaction you will become a member of the panel.

Your invitation to participate in the panel is personal and non-transferable.

Only those who are members of the panel may access the online tools and take part in customer research activities.

Your obligations

As a member of the panel, you agree to the following:

  • you will register for the panel only once; and
  • all information that you provide whenever you participate in any Customer Research Activities must be:
    • honest and accurate
    • your own responses
    • genuine (e.g. you may not provide intentionally confusing or meaningless answers.)

Emails

As a member, you agree that TMR and/or its authorised agent may email you invitations to participate in customer research activities for the panel, news updates, competition information and similar information.

TMR will preserve the content of any email that you send to, or receive from, TMR if it believes that it has a legal requirement to do so. Your email message content may be monitored by TMR employees for security issues including where email abuse is suspected. TMR's response to you may also be monitored for quality assurance purposes.

Participation in customer research activities

TMR or the service provider may contact you as a member of the panel from time to time to invite you to take part in customer research activities about TMR's products, policies, services, marketing and ideas. Panel members may be selected for such invitations according to their individual attributes as indicated in information provided in the joining survey or otherwise by panel members.

The customer research activities you will be invited to participate in may be conducted and hosted by our service providers or other market research companies who have been engaged by TMR to conduct the research on its behalf.

By taking part in customer research activities, you consent to your name, email address and responses to be collected and managed by such third parties for the purpose of conducting customer research activities on behalf of TMR.

Your contribution and feedback is very important because it will help TMR to improve the products and services it offers to its customers. Participation in TMR's customer research activities is at your discretion.

Monthly promotion

If you are invited to participate in customer research activities and you complete the requirements of any such customer research activities during any promotional period, your name will be entered for a monthly prize draw ('promotion') to be conducted according to the Terms and Conditions set out in Annexure A to this agreement, one such entry to be made for each customer research activity completed by you and selected by TMR in its sole discretion as a qualifier for entry for the promotion.

Member user name and password

To access some of the customer research activities as part of your panel membership, you may gain access to the online tools by clicking on a URL contained within an email sent to your email address.

Some customer research activities may require you to enter a member user name and password to use the online tools. To protect your password, you must:

  • protect your password from being lost, stolen or disclosed
  • not keep a written record of your password
  • not give, show or tell your password to anyone
  • not allow any person to read or hear your password, or watch you enter your password
  • log off immediately after you have finished accessing the online tools.

Please note that we will not ask you for your password.

You:

  • understand that access to your email address may allow anybody using it to obtain access to content you have contributed to the online tools and to contribute to the online tools under your member user name. Leaving your computer unattended while logged on to your email account may also lead to these consequences
  • understand that your member user name and password allow anybody using them to obtain access to content you have contributed to the online tools and to contribute to the online tools under your member user name. Leaving your computer unattended while logged on to the online tools may also lead to these consequences
  • authorise us, where the correct member user name and password relating to your membership have been entered, or where the online tools have been accessed via a URL link in an email sent to your email address, to treat any operations on the online tools, whether involving access to information or the effecting of contributions to the online tools, as having been personally authorised in writing by you
  • acknowledge that we are under no duty whatsoever to enquire or establish whether a person accessing the online tools under your member user name is a person actually authorised.

If you suspect that your password and member user name may have become known to any other person, or that for any other reason another person may have been in a position to access the online tools under your user name you must ensure that your password is changed and inform TMR immediately at TransportTalk@tmr.qld.gov.au.

Use of your panel membership

You acknowledge that you are solely responsible for all use of your panel membership under your member user name, including information accessed, contributions made to the online tools from your Account, and any breach of the Terms and Conditions of this agreement.

You are responsible for all content and responses contributed or provided to any survey, discussion forum or other customer research activity provided via the online tools including text, photos, videos, audio and links while your member user name is logged into the online tools.

Privacy Policy

By participating in the panel, including responding to surveys, contributing to discussion forums or other customer research activities via the online tools, you agree to allow TMR to use the information you provide for statistical and research purposes.

TMR is committed to protecting your privacy. TMR will only use the information collected from your joining survey responses and as part of the operation of the panel for:

  • TMR statistical and research purposes
  • selecting panel members for invitation to participate in particular customer research activities
    and
  • conducting the promotion.

TMR will not:

  • use your information, or allow your information to be used, for another company's market research
    or
  • use the information you provide as part of your membership to the panel to advertise or promote, goods or services to you.

Any personal information collected about you in the course of your participation in the panel will be used and stored in compliance with the TMR Privacy Policy and the Information Privacy Act 2009.

Despite anything in that Privacy Policy, however, the following will apply to information collected about you in the course of your use of the online tools:

  • TMR may share your personal information with all persons who assist it in the operation of the panel from time to time but only for the purposes of the operation of the panel and related research and analysis and any of those persons may contact you through any of the contact details you have provided to TMR
  • where possible, your responses will be analysed, stored and used in an aggregated and/or anonymous form.

You acknowledge and agree that information you disclose in publicly accessible parts of the online tools will be available to all panel members, so you should be mindful of personal information and other content you may wish to post.

When you complete the joining survey when applying to register as a member of the panel, information will be collected and stored using cloud technology by the service providers on behalf of TMR.

The collected information will be physically stored at the service providers' secure facilities located in Australia.

TMR has verified that the service providers maintain adequate controls and confidentiality agreements to safely host the information.

TMR has agreements with the service providers with provisions to protect your information.

Unfortunately, no data transmission over the internet can be guaranteed as totally secure. Accordingly, although TMR strives to protect your information, TMR cannot ensure or warrant the security of any information transmitted using the online tools.

Similarly, no data stored using cloud technology can be guaranteed as totally secure. Accordingly, although TMR strives to protect such information, TMR cannot ensure or warrant the security of this information and it is stored at your own risk.

The service providers are not responsible to you for the collection, storage and use of your information.

Cookies

TMR and its service providers may allocate 'cookies' to each internet browser that visits the online tools.

The purpose of using 'cookies' is to provide you with a better and more customised service and with a more effective website. A 'cookie' is a small text file place on your computer by TMR's (or our service providers') web page server. A cookie can later be retrieved by TMR's (or our service providers') webpage servers. Cookies are frequently used on websites and you can choose if and how a cookie will be accepted by configuring your preferences and options in your browser.

The cookies are used, for example, to identify pages you have viewed on the TMR website, to remember login and personalisation preferences, to ensure duplicate accounts are not created, to optimise performance of the site, and for security reasons.

TMR uses the information collected through the use of cookies to perform statistical analyses of aggregate user behaviour, but these analyses are not based on personal information.

If you would like to opt out of receiving cookies or know more about how to delete them, then please email us on TransportTalk@tmr.qld.gov.au.

Confidentiality

You must treat as confidential and not disclose to any person the content of any customer research activities in which you participate as a member of the panel or any communications between you and us in relation to the panel.

You acknowledge that material related to the panel that TMR provides to you with is copyright material owned or licensed by TMR, which may also be confidential to TMR or its licensor.

You must:

  1. treat any information contained in material posted on the online tools by TMR, and any content posted by other members, in confidence and not circulate it outside the online tools in whole or in part, by any means whatsoever
  2. not copy, disclose, publish or use any material or content posted on the online tools unless you have prior written approval granted by TMR on each and every occasion
  3. not use in any form of media or publications outside the panel any material or content posted on the online tools unless you have been granted prior written approval by TMR on each and every occasion.

You must not copy or download any material from the online tools unless directed to specifically do that as part of a customer research activity.

Member participation

Some of your participation in the panel may occur via online forums, blogs, chats or focus groups or other customer research activities that TMR or our service providers will set up using the online tools.

You agree to use the online tools only for lawful purposes. You may be held legally responsible for the content you submit to the online tools. 

All contributions to the online tools are published at TMR's sole discretion. 

There are some rules about the content you may submit to, and how you may use, the online tools. You must not:

  1. submit or transmit any content that, in our opinion, is false, misleading or in breach of any law, whether the laws of Australia or another jurisdiction, including laws relating to defamation, contempt of court, privacy, discrimination, harassment, and racial vilification
  2. submit or transmit any content that infringes of the intellectual property rights, including copyright, or the moral rights of any person 
  3. submit or transmit any content that involves party political discussion
  4. submit or transmit unsolicited commercial or advertising electronic messages, or solicit other members to buy or sell products or services or donate money 
  5. impersonate another person (for example, by pretending to be someone else when you submit a contribution to the online tools) or by using another person's account without permission
  6. tamper with, hinder the operation of, or make unauthorised modifications to the online tools
  7. submit or transmit content that contains viruses, corrupted files, or any other similar software or programs that may adversely affect the operation of the online tools, or any feature of the online tools
  8. other than connecting to TMR's (or our service providers') servers by http requests using a web browser, attempt to gain access to TMR's (or our service providers') servers by any means – including, without limitation, by using administrator passwords or by masquerading as an administrator while using the online tools
  9. disrupt, modify or interfere with the online tools or its associated software, hardware and/or servers in any way, and you agree not to impede or interfere with others' use of the online tools
  10. misrepresent a relationship with any person or organisation
  11. do anything that is unlawful in any way
  12. invade the personal privacy of any other person or group
  13. disrupt the online tools by
    1. adding unnecessarily large numbers of posts or discussions
    2. posting repetitive messages, including cross-posting, flooding and spamming
    3. creating off-topic posts
    4. manipulating topics to disrupt conversation
    5. any behaviour that interferes with conversations or stops the ability of others to use and enjoy the forums for their intended purposes
      or
    6. attempting to do any of these things or permitting another person to do any of these things.

Intellectual property rights

All copyright and other intellectual property rights in the material on the online tools and material related to the panel are owned by TMR unless otherwise indicated. You must not copy, modify, alter, distribute, publish, sell or otherwise use in whole or in part any material on the online tools or which you receive from TMR in the course of participating as a member of the panel, without the prior written consent of TMR.

You must not infringe the copyright, trade marks or other intellectual property or proprietary rights of our service provider.

Content supplied by you

You are responsible for ensuring that any content you provide to the online tools, including but not limited to text, photographs and sound, does not infringe the copyright, trademark, trade secret or any other personal or proprietary rights of any third party or is posted with the permission of the owner(s) of such rights.

You confirm you have, where appropriate, sought the consent of the parent or guardian of any person under the age of 18 who is featured in any content you contribute before posting any part of that content on the online tools.

You warrant that you own the intellectual property rights, or that you have the right to use without restriction and without incurring any obligation (including as to payment) to any other person, of all information that you provide to TMR in response to any customer research activity (your content).

You acknowledge that TMR may use all intellectual property rights in your content throughout the world, in perpetuity, without restriction and free of charge including publication of that content in hard copy publications or in electronic media, using your content in advertising and promotional material for TMR and permitting others to do any of these.

You consent to anything that TMR (or any person permitted to do so by TMR) may do in relation to the content of which you are the author, including use or publication of the content without attributing you as the author of the content.

Your consent allows TMR to edit the content provided by you at its discretion, including, while retaining its meaning, making alterations and deletions which might otherwise infringe your moral rights.

Please ensure you keep your own copies of any content you contribute to the online tools as TMR may not archive, store or back-up this content nor continue to make this content accessible online.

No duty to monitor

TMR is not responsible for content provided by others. TMR is not obligated to pre-screen content posted within the online tools, however, TMR does retain the right to refuse to post, redact or delete any content for any reason whatsoever.

Comments by others are not endorsed by TMR

TMR does not endorse or agree with the comments, opinions, statements, or other content posted on the online tools or otherwise contained in the contributions of other panellists.

The contributions on the panel online tools are created by members of the public and reflect the opinions of those who choose to make contributions, which may affect the balance of opinions contained in the contributions.

You agree that TMR is not responsible, and shall have no liability to you, with respect to any information or content posted by others.

Links to third party sites

The online tools may contain links to other websites for informational purposes and are not intended to suggest and do not indicate any affiliation with TMR unless expressly stated. The reliability, availability and performance of these other websites are beyond our control and unless such websites are provided by TMR and under its control, TMR makes no representations or warranties with respect to such websites.

You must not link to the online tools from any other website (or otherwise authorise any other person to link from a third-party website) to the online tools without our prior written consent.

Termination or suspension of access to the online tools

Your right to access and use the online tools is subject to the terms and conditions of this Agreement. TMR has the right to terminate and/or suspend your ability to access the online tools (or any part of them), for any or no reason, or may prevent your use of the online tools with or without notice to you and without compensation. You agree that TMR will have no liability to you if the online tools are discontinued or if your ability to access the online tools is terminated.

Warranty

The online tools are provided 'as is'. TMR does not make any representations or warranties of any kind for the material on the online tools. With respect to the operation of the online tools, TMR expressly disclaims all warranties of any kind, whether expressed or implied, including, but not limited to all implied warranties of merchantability or fitness for a particular purpose, of title and of non-infringement. 

TMR makes no warranty that (i) the operation of the online tools will meet your requirements; (ii) access to the online tools will be uninterrupted, timely, secure, free of viruses, worms, trojan horses or other harmful components, or free of defects or errors; (iii) the material or content accessed through the use of the online tools will be accurate or reliable; or (iv) defects will be corrected.

Liability

TMR will be under no liability to you in respect of any loss or damage (including consequential loss or damage) which may be suffered or incurred, or which may arise directly or indirectly in respect of your membership of the panel (including TMR's use of information provided by you in the course of that membership).

You indemnify TMR and its officers, employees and agents against any damage or loss made against or suffered by any of those indemnified arising, in whole or in part, as a result of:

  • the publication by TMR or a person permitted by TMR of your content
    or
  • a breach by you of the Terms and Conditions of this agreement.

For the avoidance of doubt and to the fullest extent permitted by law, TMR's service providers exclude all liability for any loss or damage (including consequential loss or damage) which may be suffered or incurred or which may arise directly or indirectly in respect of your membership of the panel (including TMR's use of information provided by you in the course of that membership) or your use of the online tools.

Governing law

These Terms and Conditions of this agreement are governed by the laws of Queensland, Australia and you submit to the non-exclusive jurisdiction of courts exercising jurisdiction in Queensland.

If for any reason a court of competent jurisdiction finds any provision or portion of the Terms and Conditions of this agreement to be unenforceable, the remainder of the Terms and Conditions of this agreement will continue in full force and effect.

Parent or guardian

As a parent or guardian of a panel member under the age of 18, as applicable, you consent to the member participating as a member of the panel and you agree to use your best endeavours to ensure that the member meets all the obligations of a panel member under this agreement. You agree to be personally bound by the Terms and Conditions of this agreement including the agreement to indemnify TMR and its officers, employees and agents as provided.

Definitions

'content' means any text, illustrations, photos, audio, video, any combination of these, or other material that you or others submit to the online tools.

'online tools' means the online customer research platforms provided for the panel by TMR’s service provider, including, but not limited to, the survey platform provided by Qualtrics and any other platforms or tools that TMR or its Service Providers may use to enable members to provide feedback or to communicate with members.

'customer research activities' means any activity to collect feedback from you and other members of the panel using the online tools, this includes, but is not limited to, polls, surveys, online discussion forums, blogs, chats or invitations to take part in face-to-face interviews, telephone interviews, or focus group discussions.

'material' means text, illustrations, photos, audio, video, and any combination of these or other material (including third party material) that TMR or its service providers or agents submit or posts on the online tools.

'member user name' means a name that uniquely identifies you on the online tools. This includes but is not limited to the email address attached to your panel membership, as well as any name you may choose to identify you on the online tools. 

'promotion' and 'promotional Period' Refer to Annexure A.

'TMR' refers to the Department of Transport and Main Roads. 

'you and your' refers to the member permitted access to the panel and a parent or guardian of a panel member under the age of 18 as applicable. Any references in these conditions to 'you' and 'your' includes a reference to any third party authorised by you to access and/or operate your member user name and password through the service, with the intent that you shall be liable for any use of a service in respect of your member user name and password and for any failure on the part of any such third party to observe the terms and conditions of this agreement.

Annexure A

Transport Talk—customer research activities—participant prize draw

By entering into the participation agreement and joining the Transport Talk panel ('the panel') and completing one or more customer research activities when invited to participate during each promotional period, you agree to enter the monthly draw to win one of five $50.00 pre-paid Flexi e-Gift cards ('the promotion'), on the following Terms and Conditions ('Terms and Conditions)':

1. The promoter

1.1. The promoter is the State of Queensland represented by Department of Transport and Main Roads (ABN 39 407 690 291) of Floor 17, 61 Mary Street, Brisbane, QLD 4000.

2. Standard terms

2.1. Information on how the promotion is entered and the prize(s) form part of these Terms and Conditions.

2.2. By entering the promotion, you ('you' and 'your' in these Terms and Conditions referring to a panel member or a parent or guardian of and representing a panel member under the age of 18) are deemed to have accepted these Terms and Conditions.

2.3. If there is any inconsistency between these Terms and Conditions and anything else that refers to this competition, these Terms and Conditions will prevail.

3. Who can enter

3.1. Entry is open to a member of the panel or a parent or guardian of and representing a panel member under the age of 18 ('entrant').

3.2. Employees in government service are ineligible to enter.  A person shall, for the purposes of this promotion, be taken to be employed in government service if the person is employed by the Commonwealth, a state or territory government, or local government whether he or she is so employed under a law or apprenticeship or engaged under a contract for services and whether he or she is employed in a full‑time or in a part‑time capacity. 

3.3. The immediate families of employees of Queensland Department of Transport and Main Roads ('promoter') are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, brother, sister, step-brother, or step-sister. 

3.4. By entering the promotion, you are providing consent for the promoter to use your personal information or as a parent or guardian of a member under the age of 18, the personal information of the member to determine your eligibility to win the promotion and contact you if you are the winner. You acknowledge and agree that if you are selected as the winner your name may be posted on the promoter's website as well as its related Queensland Government websites or social media pages and included in Transport Talk newsletters or other communications to panel members.

4. When and how to enter

4.1. Each monthly promotion commences at 0:01am AEST on the first day of each calendar month and closes at 11:59pm AEST on the final day of each calendar month ('promotional period'). Each promotional period may be extended at the discretion of the promoter without prior notice to you.

4.2. These Terms and Conditions take effect from the date of formation of the participation agreement.

4.3 To enter the promotion, entrants must, during the promotional period complete the requirements of one or more customer research activities as invited in accordance with the relevant provisions of the participation agreement or, where the entrant is a parent or guardian of a panel member under the age of 18, ensure the panel member completes those requirements.

4.4. An entry complying with clauses 3 and 4 will be a valid entry and will qualify for the prize draw.

4.5. Where a panel member completes more than one customer research activity in the promotional period, an additional entry in the prize draw for each and every additional customer research activity completed in the promotional period and selected as provided in the participation agreement will be provided.

4.6. Entries which do not comply with the minimum requirements in clauses 3 and 4 will be deemed invalid and will not be entered in the promotion.

5. Promoter's discretion

5.1. The promoter's decision in relation to any aspects of the promotion including the validity of entries is binding and the promoter will not enter into any correspondence regarding the result.

5.2. The promoter reserves the right to verify the validity of entries and entrants (including an entrant's identity) by contacting the entrant via the phone number and/or email address they supplied in the Transport Talk joining survey and requiring an entrant to produce photographic identification.

5.3. The promoter reserves the right, in its sole discretion, to disqualify any individual who the promoter believes has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper conduct in relation to the promotion.

5.4. Failure by the promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The promoter reserves all of its rights including rights to any relief against such an offender.

5.5. Errors and omissions in an entry may be accepted at the promoter's sole discretion.

6. The prize draw

6.1. The prize draw will take place at the promoter's premises at Floor 17, 61 Mary Street, Brisbane QLD 4000 by 5:00pm AEST on the second Friday following the end of each promotional period.

6.2. The Entrants acknowledge that the prize draw is a game of chance and skill plays no part in determining the outcome.

6.3. There will be five (5) winners, selected at random by the promoter ('the Winners').

6.4. The winners will be notified via the email address they supplied in the Transport Talk joining survey.

6.5. Each Winner will receive a Flexi eGift Card with the value of $50.00, which is ready to redeem online through the link in the Flexi eGift card email. The Flexi eGift card provides access to 6,000+ branded gift cards across Australia. A list of supported gift cards can be found at www.giftpay.com.au. Once your preferred gift card is chosen, your eGift card will be valid for the period of time specified on the voucher chosen from the available providers and can be activated immediately from the Flexi eGift page.  You may choose to split your Flexi e-Gift into multiple gift cards from multiple retailers. Each eGift card has its own validation period, specified prior to redemption. 

6.6. The winner will be notified by the promoter and the prize will be despatched to the winner, and will be sent via the notification email to the winner's nominated email address.

6.7. The total value of the prize available to each winner is to the value of $50.00 as a Flexi eGift card only.

6.8. The prize is not transferable or exchangeable and cannot be taken as cash.

7. No liability

7.1. If any monthly promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

7.2. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under similar consumer protection laws in the States and Territories of Australia ('Non-Excludable Guarantees'). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion including but not limited to: (a) any technical difficulties or equipment malfunction (whether or not under the promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the promoter or winner respectively) due to any reason beyond the reasonable control of the promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; or (f) attendance at the prize event.

7.3. The promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, internet failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

8. Privacy

8.1. The promoter abides by the Information Privacy Act 2009 when managing personal information. By means of the Transport Talk joining survey and further information that may be provided in the course of the operation of the panel, the promoter collects personal information ('PI') of the entrant and the winner including the winner's name, nominated email address and such other information as stated in these Terms and Conditions to award the prize to the winner or to verify an entry.

8.2. The entrant's PI as disclosed on or through the promoter's customer research activities will also be collected. The promoter will, for the purposes of the promotion only, disclose such PI to third parties, including to agents, contractors, service providers and prize suppliers in order to award the prize to the winner and to panel members in Transport Talk newsletters or other communications.

8.3. Entrants agree to provide this PI. The promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.tmr.qld.gov.au/Help/Privacy. In addition to any use that may be outlined in the promoter's Privacy Policy, the promoter may use the PI for the purposes stated in these Terms and Conditions, and in the participation agreement, unless the entrant opts out by contacting the promoter by emailing TransportTalk@tmr.qld.gov.au or by the opt out facility provided in all invitations to customer research activities. Information about how entrants may access, update or correct their PI is available at http://www.tmr.qld.gov.au/About-us/Right-to-Information/How-do-I-access-information. All entries become the property of the promoter. This promotion is conducted by the promoter using online tools provided by its service provider, which is based in Sydney, Australia for the distribution of prizes. PI provided by entrants will be transferred to the service provider's servers and data centres in Australia. By entering this promotion, entrants consent to this transfer. The promoter will not otherwise use, disclose or transfer PI except as permitted at law.
